TapSafe Terms of Use
These Terms govern your use of the TapSafe app and website provided by KVEX OÜ (“TapSafe”, “we”, “us”, “our”). By using TapSafe, you agree to these Terms.

1) Safety disclaimer (read this first)
TapSafe is a communication aid and not a substitute for calling your local emergency number. In immediate danger, call emergency services first. TapSafe depends on device battery, GPS, connectivity, carriers, third-party services, and user input. Delivery, availability, speed, and accuracy are not guaranteed.
2) Who can use TapSafe (eligibility & account)
You must be 18 or older, or the age of majority in your jurisdiction, and you must comply with applicable laws when using TapSafe.
You are responsible for maintaining accurate account information and keeping your login credentials secure.
You are also responsible for ensuring that any person you add as a recipient or trusted contact has consented to receive messages from you where required.
3) What TapSafe provides (service description)
TapSafe lets users configure emergency actions, store trusted contacts, and send alerts that may include location or other emergency-related information.
Some features require location access, notifications, background permissions, internet access, carrier services, or other device capabilities. Features may change over time, and some features may be added, modified, limited, or discontinued.
4) Subscriptions, trials, billing, and pricing
Auto-renewing subscriptions are billed by Apple or Google through their respective app store billing systems. Your subscription renews automatically unless cancelled at least 24 hours before the end of the then-current billing period.
You can manage or cancel subscriptions through your Apple App Store or Google Play account settings. Prices and taxes may vary by region.
Refunds are handled by Apple or Google under their own policies.
If you cancel a subscription, your access continues until the end of the paid billing period unless otherwise stated by the applicable app store.
If a free trial is offered, any unused portion may be forfeited when you purchase a subscription, unless the applicable app store policy provides otherwise.
We may change pricing, plans, or features from time to time. If a change materially affects you, we will provide notice where required.
Certain messaging-related features may be subject to separate fair-use limits, top-up purchases, or other usage-based restrictions as described in the app and in Section 5.
5) Messaging, fair use, top-ups, and abuse prevention
TapSafe includes messaging features that may allow users to send emergency-related SMS messages to selected recipients. You are responsible for the recipients you choose, the content you send, and for ensuring that you have the right to contact those recipients. TapSafe does not send marketing SMS messages.
To protect users, recipients, carriers, and the integrity of the Service, TapSafe may apply fair-use limits, spending limits, top-up requirements, invitation caps, delivery restrictions, throttling, temporary pauses, blocks, or other controls to messaging features.
Messaging availability may depend on your subscription tier, your included messaging allowance, any purchased top-up balance, the estimated cost of delivery, carrier requirements, destination country, and abuse-prevention controls.
TapSafe may pause, limit, or block certain SMS functionality if:
(a) your included allowance or purchased top-up balance is exhausted;
(b) the estimated cost of a message exceeds your remaining balance;
(c) an invitation or resend cap is reached; or
(d) we detect suspected abuse, fraud, spam, false emergencies, unlawful use, attempts to bypass limits, or other conduct that may harm TapSafe, recipients, carriers, or third parties.
Any messaging allowance, top-up balance, or similar in-app value is a limited service entitlement only. It is not banked money, has no cash value, is non-transferable, and is not redeemable for cash except where required by law.
Messaging allowances and top-up-related usage entitlements may reset, be recalculated, or otherwise change at the end of the applicable billing or plan period, as described in the app or purchase flow.
Message and data rates may apply depending on the recipient’s mobile carrier plan.
Recipients can reply STOP to opt out of TapSafe emergency SMS and HELP for help, where supported.
Carriers are not liable for delayed or undelivered messages.
Carrier delivery is not guaranteed. Message delivery speed, availability, and success depend on device status, connectivity, carrier routing, destination, and other factors outside our control.
False emergencies, spam, harassment, stalking, unlawful content, and unlawful tracking are prohibited.
If you believe a messaging restriction, pause, block, or enforcement action was applied in error, you may contact support@tapsafe.app.
6) Acceptable use
You agree not to:
(a) use TapSafe for unlawful acts, harassment, stalking, threats, privacy violations, or any harmful purpose;
(b) interfere with, disrupt, probe, reverse engineer, or bypass the security or operation of the Services;
(c) misuse location features to track someone without lawful basis or consent;
(d) send unlawful, deceptive, abusive, or fraudulent communications through the Service; or
(e) attempt to evade TapSafe’s limits, safeguards, or enforcement mechanisms.
7) Location & permissions
Some features require location, notifications, contacts, camera, microphone, or other device permissions. Granting access is voluntary, but certain features will not function without the necessary permissions.

8) Third-party services & app stores
TapSafe may integrate with Apple, Google, RevenueCat, Superwall, Supabase, Twilio, carriers, and other third-party service providers and infrastructure vendors. Their terms, policies, and technical limitations may also apply.

9) Intellectual property & license
TapSafe and all related content, branding, software, and materials are owned by KVEX OÜ or its licensors.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose.
You may not copy, modify, distribute, sell, sublicense, or create derivative works from TapSafe except as permitted by law or with our written permission.
10) User content & feedback
You retain rights in the content you submit through the Services, such as names or information you enter for trusted contacts.
You grant TapSafe a non-exclusive, worldwide, royalty-free license to host, process, transmit, and use that content solely as necessary to operate, maintain, and improve the Services.
If you send feedback, suggestions, or ideas, we may use them without restriction or compensation to you.
11) Open-source notices
TapSafe may include open-source software components licensed under their respective terms. Applicable notices may be provided in the app, in documentation, or upon request.
12) Privacy
Our Privacy Policy explains what we collect, how we use it, and how we share it, including in relation to location, contacts, messaging-related records, and analytics. The Privacy Policy forms part of these Terms.
13) Service changes; beta features
We may add, change, suspend, or discontinue any part of the Services at any time.
Some features may be identified as beta, preview, or experimental. These features may be unstable, incomplete, or subject to change or removal without notice.
14) Security
We use reasonable safeguards designed to protect the Services and the personal data we process, including measures such as encryption in transit and access controls. However, no system is completely secure.
15) Warranty disclaimer
To the maximum extent permitted by law, the Services are provided “as is” and “as available.”
We disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.
16) Limitation of liability
To the fullest extent permitted by law, KVEX OÜ is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising out of or related to your use of the Services.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services is limited to the greater of:
(a) the amount you paid to TapSafe in the 12 months before the claim arose; or
(b) EUR 100.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law, including for fraud, gross negligence, or death or personal injury caused by negligence where applicable law so provides.
17) Indemnity
You agree to indemnify and hold harmless KVEX OÜ and its affiliates, officers, directors, employees, and contractors from and against claims, liabilities, losses, damages, costs, and expenses arising out of or related to:
(a) your misuse of the Services;
(b) your violation of these Terms;
(c) your unlawful messaging or communications;
(d) your failure to obtain required recipient consent; or
(e) your violation of any law or third-party right.
18) Export controls & sanctions
You represent and warrant that you are not located in a country subject to embargo or broad sanctions that would prohibit use of the Services, and that you are not on any restricted or prohibited party list. You agree not to use the Services in violation of export control or sanctions laws.
19) Suspension, termination, and messaging restrictions
You may stop using TapSafe at any time.
We may suspend, restrict, limit, or terminate access to all or part of the Services, including messaging features, where we reasonably believe there has been a violation of these Terms, abuse, fraud, false emergency activity, repeated recipient complaints, attempts to circumvent fair-use limits or messaging controls, non-payment, unlawful conduct, risk to the Service, or risk to other users, recipients, carriers, or third parties.
We may also apply temporary or permanent restrictions to invitations, resends, emergency SMS delivery, top-up usage, account access, or related messaging functionality while reviewing suspected misuse or protecting the integrity of the Service.
Subscription cancellation remains managed through Apple or Google under Section 4. To request account or data deletion, use any in-app option provided or contact support@tapsafe.app from your account email.
20) Governing law & venue
These Terms are governed by the laws of Estonia, without regard to conflict-of-laws principles.
The courts of Estonia have jurisdiction, except to the extent that mandatory local consumer protection law gives you additional rights or requires a different forum.
21) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we may notify you in-app, by email, or by other appropriate means.
Your continued use of the Services after the updated Terms take effect means you agree to the revised Terms.
22) Miscellaneous
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
No waiver. Our failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign these Terms without our prior consent. We may assign these Terms to an affiliate or successor in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and TapSafe regarding the Services.
